Terms of Service

1. The service and operator

These terms apply when you use Hengust. Hengust is operated by Oliver Goodman. References to “Hengust”, “we”, “us”, and “our” mean the service and its operator. By creating an account, starting a subscription, or using Hengust, you agree to these terms.

You must use Hengust in accordance with laws that apply to you and in Australia. You must not misuse the service, interfere with its operation, or use it for unlawful activity.

2. Apple Music and what Hengust stores

Apple Music supplies music playback and catalogue content. Hengust does not provide the recordings and does not store copies of music files. Availability, playback, catalogue information, and any Apple Music subscription are governed by Apple’s services and terms.

Hengust stores catalogue references and the information needed to organise them, including your layout, spaces, playback-resume information, and sharing data. Removing an item from Apple Music or losing access to Apple Music may make a Hengust reference unavailable even though its organisational record remains in Hengust.

Apple is not responsible for Hengust, its operation, support, subscriptions, or these terms. Hengust is not represented as sponsored or endorsed by Apple.

3. Trial, subscription, and renewal

When offered at Checkout, Hengust is intended to include a 60-day free trial. You provide a payment method when the trial starts. The Checkout page shows the recurring monthly price in Australian dollars and any other billing terms that apply before you confirm. You will not be charged retrospectively for use before starting the subscription.

Before the first charge after a trial, Hengust will provide advance notice through Stripe or using the contact details associated with your billing account. After the trial, the subscription renews automatically each month at the displayed recurring price until cancelled.

You can manage or cancel through the Stripe Customer Portal when it is available. Checkout or the Portal will describe when cancellation takes effect and whether access continues to the end of a billing period. A cancellation stops future renewal according to that description; it does not create a refund right beyond any right required by law or expressly offered at the time.

If payment fails, Stripe or Hengust may retry payment. Hengust may allow temporary continued access while payment is resolved, then limit or suspend subscription features. Any grace treatment will be disclosed through the service or billing communications and is not guaranteed for a fixed period.

4. Your data and service availability

Hengust is still developing. We take reasonable steps to operate the service, but cannot promise uninterrupted availability or that every catalogue reference, layout, or other record will always be retained. Keep any backup the service enables you to download.

After cancellation, failed payment, suspension, or account closure, we may retain account and organisational data for a reasonable period to support restoration, billing records, disputes, security, and legal obligations. We may later delete it. Hengust does not promise a particular retention period unless one is separately disclosed.

We may suspend or close an account for unlawful, abusive, unsafe, or materially inappropriate use. Where reasonably possible, we will take account of the circumstances before deleting user data. If there is reasonable suspicion of unlawful activity, logs and other relevant information may be provided to law enforcement where permitted or required by law.

5. Sharing and user-provided content

Hengust may let you share spaces, layouts, titles, notes, or other organisation data with other people. You control what you share and who receives a sharing link or grant. A recipient may retain information you have shared even after you stop sharing it.

You must have the rights needed for content you add or share. You keep your rights in that content and give Hengust only the permission needed to store, process, display, and transmit it to operate the service and carry out your sharing choices. Do not use Hengust to share recordings or other material in breach of copyright.

Copyright complaints should be addressed to Oliver Goodman using the contact method made available through Hengust. A notice should identify the copyrighted work, the material complained of, where it appears, your contact details, and the basis for your good-faith claim. We may restrict access to material while a complaint is assessed.

6. Consumer rights and responsibility

Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law. Those rights remain unaffected.

Subject to those non-excludable rights, Hengust is supplied on an “as available” basis. To the extent permitted by law, we do not promise that the service will meet every purpose, remain error-free, or preserve access to third-party catalogue content.

7. Changes and contact

We may update these terms as the service changes. A new effective date will be shown, and material changes will be brought to users’ attention where appropriate before they take effect.
